Terms of Service

These terms govern your use of Latuvo (the iOS app + associated services). By creating a Latuvo account or otherwise using the service you agree to them. If you don't agree, don't use Latuvo.

1. Eligibility

You must be 18 or older. By signing up you confirm that you are at least 18 years of age. We rely on your declaration of date of birth at signup. If we discover you were under 18, we will delete your account.

You also confirm that:

• You're using Latuvo for yourself (not on behalf of a minor)
• You're legally able to enter into this agreement under Romanian law
• Latuvo is not prohibited in your country of residence

2. Your account

You're responsible for:

• Keeping your password and device safe
• The accuracy of the information you enter (name, date of birth, gender, match results)
• Everything that happens on your account

If you suspect unauthorized access, write to support@latuvo.com and we will help you reset access.

We may suspend or terminate accounts that:

• Are operated by users under 18
• Submit fabricated or systematically inaccurate match data
• Harass or abuse other users via discovery, match comments, or shared contact channels
• Attempt to compromise Latuvo's systems or other users' accounts

3. What Latuvo provides

Latuvo records your tennis matches, computes a rating from them, and surfaces statistics on the iOS app and Apple Watch app. We provide the service "as is" — we don't guarantee:

• Continuous, uninterrupted availability
• The accuracy of any opponent's claimed identity, rating, or location
• That match results submitted by your opponents are accurate
• That HealthKit data is medically accurate (it's a consumer fitness signal, not a medical device)
• That Latuvo will discover any specific user near you (depends on opt-in coverage in your area)

Latuvo is not a medical device or a diagnostic tool. Heart rate, calories, and other fitness signals are estimates from consumer-grade sensors; do not use them to make health decisions. If you have a medical condition, consult a doctor before using the watch during intense play.

4. Player Discovery and contact

When you opt in to Player Discovery, your approximate location and profile basics (name, handle, rating, optional preferred contact handle) become visible to other opted-in Latuvo users near you. You can opt out anytime in Profile.

If you share a contact handle (Instagram, WhatsApp, email, etc.) on your profile, you understand:

• It's shown publicly to other Latuvo users
• Other users will contact you off-platform through that channel
• Latuvo does not moderate, monitor, or take responsibility for conversations on external channels
• You are responsible for what you share

We expect everyone using Latuvo to be respectful. Harassment, threats, hate speech, or unwanted sexual contact via discovery or on any external channel you reach through Latuvo can result in account termination. Report incidents to support@latuvo.com.

5. Subscription and payments

Some Latuvo features may require a paid subscription. Subscriptions are billed through Apple's App Store under Apple's standard terms; we don't see or store your payment card data. You can cancel anytime in Settings → Subscriptions.

Refunds for App Store purchases are handled by Apple per their policies, not by Latuvo directly.

6. License

Latuvo grants you a personal, non-exclusive, non-transferable, revocable license to use the app on iOS devices you own or control. You may not:

• Reverse-engineer or attempt to extract source code from the app (beyond what Romanian law explicitly permits)
• Resell, sublicense, or commercially redistribute the app
• Use Latuvo to build a competing service by scraping its data
• Bypass the in-app DOB gate or any other protection

7. Your content

You retain ownership of the match data, photos (avatar), and stats you create in Latuvo. By using the service you grant Latuvo a limited license to:

• Store, process, and display your data within the app and to other Latuvo users you've matched against
• Use anonymized, aggregated stats for cohort comparison (when you opt in to share_for_cohort)
• Show your match results to opponents on shared matches

We will not sell your data, use it for advertising, or share it with third parties beyond what's in the Privacy Policy.

8. Termination

You can delete your account at any time via Profile → Delete Account. We will erase your data per the Privacy Policy retention schedule.

We can terminate your account if you breach these terms. We'll notify you by email when possible.

9. Liability

To the maximum extent permitted by Romanian law:

• Latuvo's total liability to you, for any claim arising from the service, is limited to the amount you paid Latuvo in the 12 months before the claim
• Latuvo is not liable for indirect, incidental, consequential, or punitive damages
• Latuvo is not responsible for what other users do (on or off the app), including any contact made via a preferred-contact handle, harassment, or impersonation
• Latuvo is not responsible for injuries during tennis matches — that's on you and your court

Nothing in this section limits liability for fraud, willful misconduct, or anything Romanian law doesn't allow us to limit.

10. Governing law and disputes

These terms are governed by the laws of Romania, without regard to conflict-of-law principles.

Any dispute that can't be resolved between us will be brought before the competent courts in Bucharest, Romania. EU users retain any mandatory rights they have under their local law.

11. Changes to these terms

We can update these terms when we change the service. Material changes will be notified in-app and by email at least 14 days before they take effect. Continued use of Latuvo after the effective date means you accept the updated terms.
